 WHAT IS A COLLECTIVE AGREEMENT?

A collective agreement is a legally-binding and enforceable document that is negotiated and signed by both the union and the employer. It is upheld by a province’s Labour Relations Board.

The terms in the agreement may provide clear standards around such topics as wages, benefits, vacation time, paid and unpaid leaves, job security, training, anti-harassment, occupational health and safety, and hiring policies. A strong collective agreement with good protections and benefits for workers is won through building unity and collaboration among workers, and engaging in a diversity of strategies that increase the leverage of workers at a worksite. Union members themselves determine the priorities for bargaining, and participate in the bargaining process with the support of the union. In the case of a workers’ cooperative where members have no single employer, the collective agreement is a document that members have agreed will outline their conditions of work.

 CAN I BE FIRED FOR JOINING A UNION OR TALKING TO UNION ORGANIZERS?

Across Canada, the right to unionize and collectively bargain is protected by the Constitution, and the Supreme Court of Canada has upheld this right.

Each province has labour laws that outline an employee’s constitutional right to join a union and participate in union activities without fear of retribution and without discrimination. Your employer cannot fire, suspend, intimidate or transfer you for joining a union or participating in a union drive during your breaks, after work, and in your own free time.

 IF I SIGN A UNION CARD, WILL MY EMPLOYER BE NOTIFIED?

No. Your prospective membership in a union is kept confidential by both the union and the Labour Relations Board.

Your vote to join a union, which occurs in some provinces after a majority of cards are signed, also remains confidential.

 IF MY CO-WORKERS AND I JOIN A UNION, WILL WE NEED TO GO ON STRIKE?

A strike is one strategy among many that is sometimes used by workers to exert pressure on their employer. It is generally rare for collective agreement negotiations to result in a strike or lock-out.

The decision to go on strike is made exclusively by the members through a vote. It is always up to the workers to decide whether or not to take this course of action.
